Is a will binding if signed while on heavy doses of morphine for pain management?
My father died recently and we have obtained a will which lists a “friend” as sole beneficiary. He was in a hospice for five weeks before passing away and on high doses of morphine to cope with pain from bowel cancer.
The will was “signed” a week before his death and the signature looks nothing like his own.
Is a person in sound mind when in huge amounts of pain and drugged up to cope?
Chosen Answer:
Sounds extremely fishy. You’re going to have to pay a lawyer to investigate this one. For a start, it doesn’t look like his signature. What lawyer was involved in the drawing up and signing of this new will and who signed as witness? Or was it just scribbled out on a scrap of paper?
“Of sound mind and body” would seem to NOT apply in this case but you’ll need medical reports too.
